Your continued use after such changes signifies acceptance of the revised Terms. You may be required to actively agree to these Terms (e.g., by checking a box or clicking "I Accept") during account creation or key interactions.
Eligibility Requirements: You must be at least 18 years old or the legal age of majority in your jurisdiction and have the legal capacity to enter into contracts. Businesses must be duly registered entities with authority to operate an e-commerce store.

Security Breaches: Notify us immediately at support@webimaker.com or +91 9083527119 if you suspect unauthorized access or a security breach. We are not liable for losses resulting from your failure to secure your account or promptly report breaches.
Multiple Accounts: Creating multiple accounts to bypass restrictions, evade fees, or manipulate services is prohibited and may lead to termination of all associated accounts.
Account Limitations: We may impose limits on account features (e.g., storage, bandwidth, page creation, blog creation, product creation, inventory, coupons, digital products, custom domains) based on your subscription plan. Exceeding these limits may require upgrading your plan or incur additional fees.

Support for third-party payment gateway integrations.

Premium Features: A suite of advanced modules and integrations available for one-time purchase.
Service Availability: We aim to provide uninterrupted access but do not guarantee continuous availability due to scheduled maintenance, upgrades, or unforeseen technical issues. We are not liable for losses caused by service interruptions.
Modifications: We may modify, suspend, or discontinue any feature, tool, or service at our discretion without prior notice or liability.

Accurate Listings: All product descriptions, images, pricing, and availability details must be accurate, lawful, and not misleading. You are liable for disputes or claims arising from inaccurate, fraudulent, or non-compliant listings.

Taxes and Duties: You are responsible for calculating, collecting, and remitting all applicable taxes (e.g., GST, VAT) and customs/import duties related to your sales.
Store Policies: You must maintain clear, accessible policies for your store (e.g., shipping, returns, privacy) and ensure they comply with applicable laws. These policies are your responsibility and do not bind Webimaker.com.
Fee Structure: You agree to pay all applicable fees, including:
Subscription Fees: Charged monthly or annually in advance based on your selected plan for access to the Platform’s website creation and management tools.
Premium Features (One-Time Payments): Users may choose to upgrade their store by purchasing powerful premium features. These are charged as a one-time price ("Pay once, use forever") per feature.
Third-Party Payment Gateways:
Ownership and Configuration: Webimaker.com does not charge transaction commissions. Users are responsible for integrating and maintaining their own third-party payment gateway accounts.
Available Integrations: Users can unlock and configure various gateways including Razorpay, Stripe, PayPal, Cashfree, PhonePe, Paytm, CCAvenue, PayU, Instamojo, and direct UPI Payment (via QR code).
Refund Handling: All customer refunds must be managed by the store owner through their respective payment gateway provider or manual banking channels. Webimaker.com does not process or facilitate customer-to-store refunds.
Liability: Webimaker.com is not liable for any issues, transaction failures, or disputes occurring within third-party payment gateway environments.
Advanced Premium Features: In addition to payment gateways, the following premium features are available for one-time purchase:
Store Management: Coupon System, COD Extra Charges, Minimum Order Value, Invoice PDF generation, and Abandoned Cart tracking.
Customer & Order Management: Order Cancellations with auto-wallet refund, Product Returns/Replacements workflow, and Customer Wallet system.
Shipping Integrations: Automated order creation and tracking via Delhivery, Shiprocket, Ekart Logistics, NimbusPost, Pickrr, iThink Logistics, Shipway, and ShipClues.
Marketing & Analytics: Google Analytics, Facebook Pixel, and Google Tag Manager.
Customer Engagement: Floating WhatsApp Button, Google Login, and Product Reviews with photo uploads.
Advanced Modules: Print on Demand (custom design uploads), Multi-Seller Marketplace system, and custom Android App development.
Late Payments: If we cannot process payment for subscription fees within 28 days of the initial attempt, we may suspend your account. If fees remain unpaid for 60 days after suspension, we may terminate your account.
Refund Policy: All fees (Subscription and Premium Feature purchases) are non-refundable, except if no services are provided within 7 days of payment. You must notify us within 30 days at support@webimaker.com.
Your Content: You retain ownership of content you upload but grant Webimaker.com a perpetual, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, distribute, and display such content for operating, improving, and promoting the Platform.
Our Content: All intellectual property related to the Platform—including software, templates, designs, trademarks, logos, and branding—is owned by Webimaker.com or its licensors.
Our Privacy Policy governs how we collect, store, process, and protect your personal and business data. As a store owner, you are the data controller for your customers’ information and must comply with all applicable data protection laws (e.g., GDPR, CCPA). You must obtain and maintain valid consents from your customers for data collection.
Voluntary Termination: You may terminate your account by following the cancellation process. Termination does not entitle you to refunds for prepaid fees.
Our Rights: We may suspend or terminate your account immediately if you breach these Terms, fail to pay fees, engage in illegal activity, or pose a risk to the Platform.
Suspension Effects: During suspension, you may lose access to your account, store, and data.
Post-Termination: Upon termination, your access ceases. We may delete your data or retain it as required by law.
The Platform is provided "as is" and "as available," without warranties of any kind. Our aggregate liability for any claims is limited to the total fees you paid us in the 7 days preceding the claim. We are not liable for indirect, incidental, special, punitive, or consequential damages.
You agree to indemnify and hold harmless Webimaker.com from any claims, damages, or expenses arising from your use or misuse of the Platform, your violation of these Terms, or disputes with your customers or third parties.
If your subscription or tenancy plan expires and is not renewed within 30 days from the expiry date, we reserve the full right to permanently delete your store, including all data, content, and files, without further obligation. Before deletion, we will make reasonable efforts to notify you via phone, WhatsApp, or email.
The Platform offers integrations with third-party services. We do not control, endorse, or warrant the performance of these services. Your use is at your own risk. You authorize us to share necessary data with third-party providers to enable integrations.
We may introduce new features, modify existing ones, or discontinue services at our sole discretion without prior notice. You are not entitled to compensation, refunds, or credits for changes that affect your store experience or costs.
You are responsible for determining, calculating, collecting, and remitting all applicable taxes related to your sales. Webimaker.com, with a turnover below Rs 20 lakhs, does not provide GST invoices.
Any non-public information provided by Webimaker.com (pricing, technical specs, business plans) is confidential. You may not disclose or use such information for purposes other than using the Platform.
We reserve the right to review, monitor, or remove any user-generated content that violates these Terms or applicable laws without prior notice. Prohibited content includes material that is obscene, violent, threatening, or deliberately false.
By using the Platform, you consent to receive communications from us electronically (email, in-app, WhatsApp). You cannot opt out of essential service-related communications.
Any feedback or suggestions you provide are voluntary and non-confidential. We may use or implement them without compensation or attribution to you.
You must comply with all applicable export control laws and sanctions. You may not use the Platform to conduct business with individuals or entities subject to sanctions or embargoes.
We strive for accessibility but do not guarantee full compliance with accessibility standards (e.g., WCAG). These Terms are provided in English; any translations are for convenience only.
You are responsible for maintaining appropriate insurance coverage for your business (general liability, product liability, etc.). We do not provide insurance for your store.
We may engage subcontractors to provide portions of the Platform’s services. All claims regarding service issues must be directed to Webimaker.com.
You represent that you have the legal authority to enter into these Terms and that your use of the Platform and your products will comply with all applicable laws and will not infringe on third-party rights.
Provisions that, by their nature, should survive termination (indemnification, liability, IP, payment obligations) will remain in effect after your account is terminated.
Participation in affiliate or referral programs is subject to separate terms. We reserve the right to modify or terminate such programs without notice.
Your use of the Platform is also governed by supplementary policies (Acceptable Use, Cookie Policy) which are incorporated into these Terms by reference.
Upon purchasing a subscription, you create a subdomain. You may attach your own custom domain (e.g., mystore.com) to your store. You are responsible for purchasing the domain and correctly configuring DNS records. Webimaker.com is not liable for issues arising from registrar problems or incorrect configuration.
Themes can be customized using provided tools. Access to certain themes depends on your subscription plan. You are responsible for ensuring customizations remain compatible with platform updates.
Webimaker.com offers only monthly and yearly subscriptions. No lifetime plans are available. Plans include specific features and limits as detailed on the pricing page.
Upon payment, the Platform automatically begins creating your website. Once successfully created, you will receive login credentials (username, password, login URL) via email and on your dashboard. You may manage multiple stores under one account by initiating new subscriptions.
Force Majeure: We are not liable for delays due to events beyond our control.
Severability: If any provision is deemed unenforceable, the remaining provisions remain valid.
Entire Agreement: These Terms constitute the entire agreement between you and Webimaker.com.
All disputes related to these Terms must be raised within 30 days of the incident. Our liability is limited to the fees paid in the last billing cycle.
